- SERVICE DESCRIPTION
2.1 SMS Services Overview
YAFI.ai provides comprehensive SMS messaging services, including but not limited to bulk SMS transmission, automated messaging, two-way messaging capabilities, SMS API integration, and message analytics. Our Services enable businesses to communicate effectively with their customers through text messaging channels.
2.2 Service Availability
While we strive to maintain consistent service availability, YAFI.ai does not guarantee uninterrupted access to the Services. We reserve the right to modify, suspend, or discontinue any aspect of the Services with reasonable notice, except in cases of emergency or force majeure.
2.3 Service Limitations
Message delivery is subject to carrier networks and recipient device capabilities. YAFI.ai cannot guarantee delivery to all mobile devices or networks. International messaging may be subject to additional restrictions and regulations.
- USER REGISTRATION AND ACCOUNT
3.1 Account Creation
To access our Services, you must create an account by providing accurate, current, and complete information. You agree to update your account information promptly to maintain its accuracy. YAFI.ai reserves the right to reject any registration or cancel an account at our discretion.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You must immediately notify YAFI.ai of any unauthorized use or security breach. We are not liable for any loss resulting from unauthorized account access due to your failure to secure your credentials.
3.3 Account Verification
YAFI.ai may require additional verification procedures to confirm your identity and business legitimacy. Failure to complete verification processes may result in service limitations or account suspension.
- ACCEPTABLE USE POLICY
4.1 Permitted Use
You may use YAFI.ai SMS Services solely for lawful business purposes in compliance with all applicable laws, regulations, and industry standards. Services must be used in accordance with telecommunications regulations in all jurisdictions where messages are sent or received.
4.2 Prohibited Activities
Users are strictly prohibited from:
Sending unsolicited commercial messages (spam)
Transmitting malicious, fraudulent, or deceptive content
Violating any third-party rights, including privacy and intellectual property rights
Sending messages containing illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
Using the Services for phishing, spreading malware, or other cybercriminal activities
Attempting to circumvent service limitations or security measures
Reselling Services without explicit written authorization
4.3 Compliance Requirements
Users must obtain proper consent from message recipients before sending communications. You must provide clear opt-out mechanisms and honor all unsubscribe requests promptly. Compliance with regulations such as TCPA, CAN-SPAM, GDPR, and other applicable laws is mandatory.
- PRICING AND PAYMENT
5.1 Service Fees
Pricing for YAFI.ai SMS Services is based on the selected service plan and usage volume. Current pricing information is available on our website or through your account dashboard. Prices are subject to change with thirty (30) days’ notice.
5.2 Payment Terms
Payment is due according to the billing cycle selected during registration. We accept major credit cards and electronic payment methods. All fees are non-refundable except as expressly provided in these Terms or required by law.
5.3 Late Payments
Failure to make timely payments may result in service suspension or termination. YAFI.ai reserves the right to charge late fees and interest on overdue amounts at the maximum rate permitted by law.
- INTELLECTUAL PROPERTY
6.1 YAFI.ai Property
All intellectual property rights in the Services, including software, designs, trademarks, and content, remain the exclusive property of YAFI.ai or our licensors. These Terms do not grant you any rights to our intellectual property except as necessary to use the Services.
6.2 User Content
You retain ownership of content you transmit through our Services. By using the Services, you grant YAFI.ai a limited license to process and transmit your content as necessary to provide the Services. You represent that you have all necessary rights to the content you transmit.
6.3 Feedback
Any suggestions, feedback, or improvements you provide regarding the Services become the property of YAFI.ai, and we may use such feedback without compensation or attribution.
- PRIVACY AND DATA PROTECTION
7.1 Data Collection and Use

- LIMITATION OF LIABILITY

YAFI.ai SMS Services are provided “as is” and “as available” without warranties of any kind, either express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
8.2 Limitation of Damages
To the maximum extent permitted by law, YAFI.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
8.3 Indemnification
You agree to indemnify and hold harmless YAFI.ai, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.
- TERMINATION
9.1 Termination by User
You may terminate your account at any time by providing written notice to YAFI.ai. Termination does not relieve you of payment obligations for services already rendered.
9.2 Termination by YAFI.ai
We may suspend or terminate your account immediately for violation of these Terms, illegal activities, or non-payment. We may also terminate for convenience with thirty (30) days’ notice.
9.3 Effect of Termination
Upon termination, your access to the Services will cease immediately. YAFI.ai may delete your data after termination, subject to legal retention requirements. Provisions intended to survive termination shall remain in effect.
- DISPUTE RESOLUTION
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which YAFI.ai is incorporated, without regard to conflict of law principles.
10.2 Arbitration
Any disputes arising from these Terms or the Services shall be resolved through binding arbitration conducted by a recognized arbitration institution. The arbitration shall be conducted in English, and the arbitrator’s decision shall be final.
10.3 Class Action Waiver
You agree to resolve disputes with YAFI.ai on an individual basis and waive any right to participate in class actions or class arbitrations.
- GENERAL PROVISIONS
11.1 Entire Agreement
These Terms constitute the entire agreement between you and YAFI.ai regarding the Services and supersede all prior agreements and understandings.
11.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
11.3 Assignment
You may not assign or transfer your rights under these Terms without YAFI.ai’s prior written consent. YAFI.ai may assign these Terms without restriction.
11.4 Force Majeure
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including natural disasters, war, terrorism, pandemic, or government actions.
11.5 Notices
All notices under these Terms shall be in writing and delivered to the email address associated with your account or to YAFI.ai’s registered business address.
